Workers Compensation - Important Instructions for Employees and Claimants

1. Never go to work comp court without your work comp lawyer for a hearing, mediation or otherwise unless instructed by your personal injury lawyer.


2. Always make all of your personal injury complaints for your entire body to all treating and evaluating doctors.  If you see a doctor that specializes in back injuries, still convey injuries you are suffering elsewhere.


3. Never submit your health insurance information to a doctor for a work related injury, unless specifically instructed by your Missouri work comp lawyer.


4. When your Missouri injury lawyer sends you to an IME or evaluating doctor you must not understate or down play your conditions and disabilities that pre-existed the work related injury or disability, as this will seriously and adversely affect your second injury fund claim for proceeds.


5. Never use the word "better" such as, "My neck is better" unless you mean that it is 100% fixed, as "better” is subject to different meanings. (Better than yesterday vs. 100% better).

8. Work comp Insurance companies do hire investigators, and if you see anyone following you or videotaping you while you are receiving benefits while out of work because you are physically unable to work, or if any adverse conduct or action is taken against you at work, contact your lawyer immediately.


9. Always be presentable, polite, and friendly with the employer's Missouri work comp physicians, but feel free to question the workers compensation physician about the treatment and your prognosis. Record Missouri workers’ compensation physician's statement to you in your diary.
